With the vote of the KPFK LAB last Saturday, we have now met the requirements of the Settlement Agreement and the Court's July 14th Order for adoption of bylaws -- and "Draft B" now is the Pacifica bylaws.

The Court's July 14th order also required that the term of this interim board terminate no later than January 30, 2004. In order to meet that deadline, the nominations for election of Delegates need to open NOW, and absolutely no later than September 5th.

The bylaws provide, at Article Four, Section 7, Transition Election, as follows:
SECTION 7. 2003 TRANSITION ELECTION Following the adoption of these Bylaws, and consistent with that Settlement Agreement dated December 12, 2001, there shall be an election for all Delegates for each radio station area. The interim Board of Directors, by resolution, shall establish a nomination and election time frame for said elections, which time frame may be shorter and on dates other than those set forth in Section 5 of this Article of these Bylaws.

I request that you call a special board telephone meeting for Wednesday September 3rd, where I will bring the following motion:

"Resolved that the interim Board of Directors establishes the following nomination and election time frame for transition elections:
1) Nomination of Delegates shall open on September 5th and close on November 5th, 2003.
2) Ballots and candidates written statements shall be mailed to the members on November 25th.
3) Ballots must be returned by the members no later than December 20th.
4) The ballots shall be counted and the results certified by the Elections Supervisor by December 30th.
5) The newly elected Delegates for each station area shall meet to elect national directors no later than January 10th, 2004.
6) The newly elected Pacifica directors shall be seated at a meeting no later than January 30, 2004."
